These Terms of Service ("Terms") govern your access to and use of the HeyBen Benefits Operations Platform ("Service") operated by YourFunnelGuy Marketing OPC ("we," "us," or "our"), a One Person Corporation registered in the Republic of the Philippines. By creating an account or using the Service, you agree to be bound by these Terms.
You must be at least 18 years old and authorized to enter into binding agreements on behalf of your organization to use HeyBen. The Service is intended for benefits brokers, insurance agencies, and their authorized staff.
You agree to provide accurate, complete, and current information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
You may use HeyBen solely for lawful business purposes consistent with these Terms. You agree not to:
HeyBen offers subscription plans billed on a monthly recurring basis. By subscribing, you authorize us to charge your selected payment method automatically at the start of each billing cycle. Subscription fees are charged in advance and quoted in US Dollars (USD).
Prices are subject to change with 30 days' prior notice communicated via email or in-app notification. Applicable taxes, if any, are the responsibility of the subscriber.
Free trials are available for 14 days. No credit card is required to begin a free trial. At the end of the trial period, you must select a paid plan to continue using the Service.
All subscription fees are non-refundable. Once a billing cycle has been charged, no refunds or credits will be issued for unused portions of the subscription period, downgrades, or early cancellations. The only exception is if a refund is required under applicable Philippine law or as expressly stated in a separate written agreement. See our full Refund Policy for details.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing cycle. You will retain access to the Service until the end of the period already paid for. We do not prorate or refund partial months.
HeyBen uses artificial intelligence to generate summaries, reply drafts, and responses based on documents you upload. You acknowledge that:
You retain ownership of all documents, data, and content you upload to HeyBen ("Your Content"). By uploading content, you grant us a limited license to process and use Your Content solely to provide the Service to you. We do not use Your Content to train AI models for use outside your account.
Each party agrees to keep the other's confidential information secure and not to disclose it to third parties except as necessary to provide or use the Service, or as required by law.
We implement reasonable technical and organizational measures to protect your data, including encryption in transit (TLS) and at rest (AES-256). No system is perfectly secure and we cannot guarantee that unauthorized access will never occur. For details, see our Security page.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by applicable law, YourFunnelGuy Marketing OPC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total aggregate liability to you for any claims arising under these Terms shall not exceed the total fees you paid to us in the three (3) months preceding the claim.
Either party may terminate the agreement at any time. You may cancel your subscription from your account settings. We may suspend or terminate your account for violations of these Terms, with or without prior notice. Upon termination, your access to the Service will cease and your data may be deleted in accordance with our data retention policy.
These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the proper courts of Antipolo City, Rizal, Philippines.
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
